Terms and Conditions


These Terms and Conditions apply to all transactions between you and Pirates Cave Limited. They do not affect your statutory rights. Please read them carefully.

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website.

These Terms and Conditions are governed by English law and are subject to the non- exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.

Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the remainder of these Terms and Conditions.

Customer Orders

We will treat each order for goods as an offer by you to purchase the goods subject to these Terms and Conditions.

To order goods over the telephone or on our website you must be at least 18 years of age.

All telephone orders will be acknowledged verbally at the time of order, and all orders placed on our website will be acknowledged electronically by e-mail. Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and Pirates Cave Limited will take place once the goods have been despatched or collected. (We may decline all or part of your order for any reason, in which case we will inform you in-person, by telephone or by e-mail).

We will tell you if your payment details cannot be authorised for any reason and invite you to pay by an alternative method.


The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, the imposition of any taxes or duties, or, if due to an error or omission, the price published for the goods is wrong whether or not the order has been acknowledged. We will of course inform you of the correct price first and give you the opportunity to cancel the order.

All product prices are inclusive of VAT, where applicable, but exclusive of delivery charges which will be payable as indicated at the time the order is placed.

From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we will try to offer you an alternative.

On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store.

We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from those in-store.

Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will contact you and ask you whether you wish to cancel your order or continue with the order at the correct price. We will not be obliged to supply goods at the incorrect price.

Prices that are reduced for sales and promotions are only valid for the specified period.

Buy & Collect

Buy and collect is available on all orders and is subject to availability.

We request that you give us a minimum of 3 working hours after reserving your order before visiting the store to collect your item(s).

If the product you have purchased is not in stock, we will contact you as soon as possible using the details you have given us. However, to avoid any disappointment, we strongly recommend that you telephone us before visiting to collect your purchased item(s).

If you buy an item that is not in stock you will have the following choices offered to you:

  1. continue with your order as placed and to collect your item once it is in stock.
  2. an alternative product - you will then either be refunded or required to pay any difference in price between that of the original product ordered and the alternative product as chosen.
  3. to cancel your order and receive a full refund.

Delivery is charged as priced on each order. You will be informed of the delivery charge before you place your order on most items. However, certain items of particular size and weight (for example, a Liferaft) will be priced after checkout has completed - if you would like to know an exact delivery charge please contact us beforehand. If after checkout we present a delivery charge you are unhappy with we will be happy to cancel your order and issue a full refund. We will never charge you additional postage without confirming with you first.

Free Delivery is available on items with a value exceeding a threshold as stated on the checkout page. Although some items exceed the Free Delivery threshold, Delivery will need to be charged after checkout on larger items such as Liferafts, but we will inform you of this before any charge for delivery is made.

Where items are in stock and ordered by the cut off time of 3pm on a working day, we will depsatch your order to you for delivery on the next working day. Where orders are placed at weekends or bank holidays, your order will be despatched on the next working day for delivery the following day. However, even with the best intentions, mistakes and delays with couriers can occur and so deliveries can, at worst, take up to 21 working days. European and International orders may take longer.

If you wish to cancel your order after it has been despatched, you will be charged for both delivery and collection costs.

If you are unavailable when our delivery partner tries to deliver your order, they may:

  1. leave the product in a place they feel is safe
  2. try to deliver again the next working day
  3. drop a card in to offer you a collection from a local collection point.

If you should refuse delivery of goods, or are not available to accept the delivery on both delivery attempts, you will be required to cover any additional costs incurred.

All quoted delivery prices, unless otherwise stated, are for most UK Mainland addresses.

Our couriers consider shipments to the following locations as not "UK Mainland" and so will incur additional charges and may also experience delays: Scotland Mainland, Scottish Highlands and Orkney Isles (PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE), International, European, Northern Ireland (BT), Isle of Wight (PO30-37), Isle of Man (IM)

We will only deliver goods to the address on the order.

Import Duty of Tax

Please note that if the delivery address is given on an order that is outside of the EU an import tax may be payable upon receipt of the goods. The amount payable depends on the destination and may be subject to charge. These payments are the responsibility of the customer and we accept no liability for the payment which may be due.

Order Processing

Your order is sent directly to our secure till in our shop for processing. Once we have received your order and payment, our staff will pick, pack and despatch the item. We will aim to do this the same day for all orders made by 3pm on Mon-Fri (excl Bank Holidays).

Security (SAGEPAY)

Why you can feel secure shopping with us

When you shop with us, our secure server encrypts all of your personal information, including name, address and credit card information. We use SagePay which are an industry leader in secure internet transactions. SagePay are used by thousands of other UK businesses for transaction security.

Industry leading transaction security

All transaction information passed between our website and the SagePay Payment System is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and all messages from SagePay are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing passed to SagePay can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Internationally recognised encryption and data storage

Once on the SagePay system, all sensitive data is secured using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data they hold is extremely secure and they are regularly audited by the banks and banking authorities to ensure it remains so.

Private network links to banks

SagePay has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

Employee access

No individuals within our company or SagePay are able to decrypt transaction information or cardholder data. Their systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your card information is secure even from their own employees because the systems never display the full card numbers, even on administration screens.


The laws of England shall govern these Terms and Conditions of Sale and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
